That’s because the Department of Justice has proposed a change to an obscure rule, “Rule 41,” that governs how criminal investigations are conducted. Previously, federal judges could only authorize hacking of computers located within their areas of jurisdiction. The FBI’s proposal would let them access information on computers located anywhere in the world.[1] These rules can be changed by the federal court system; no public debate or legislative activity is required. But they used the warrant to hack into more than 1,300 computers across the country.[2] When other courts looked at the case, they determined that the FBI acted outside the bounds of their warrant in hacking most of these computers. So the FBI asked the Supreme Court to change the underlying rule, and the Supreme Court agreed. If the changes are allowed to take effect on December 1, law enforcement will be able to easily obtain warrants to hack into any electronic device located anywhere in the world. And this wouldn’t only affect people suspected of criminal activity. The rule change would let the FBI get warrants to hack into any computer that conceals its location through technical means, including those belonging to people who use Tor browser or VPNs. It also targets computers that have been “damaged without authorization,” which means that anyone caught up in a botnet or attacked by malware could be vulnerable to FBI hacks. We need Congress to step in and stop this massive expansion of surveillance hacking power before millions of people have their rights violated.
